Terms and conditions

These terms and conditions apply to all work carried out by Sarah Louise Bellis (hereinafter, “Word2Word”) for her clients. All orders imply full acceptance by the client of these terms and conditions.

 

  1. Quotation, services and project procedure

Quotation

Quotations are valid for 30 days.

Quotations are fixed and final and do not cover changes to the original document. In the event of alterations to the original document, a new fixed quote will be issued. Under no circumstances shall the translator be held liable for delays and/or damages of any kind arising from these circumstances.

At all times Word2Word reserves the right to correct any errors in its quotations, invoices and correspondence, including any related to typography or calculations, as well as any results arising from such errors. 

Acceptance of the quotation and order confirmation

To accept the quotation, please follow the payment instructions as indicated on the quotation, and email us the signed and/or stamped quotation (info@word2word.es) together with proof of payment.

An order shall be deemed confirmed once the client has made payment and returned the signed quotation by email.

Delivery times for orders will be specified in the quotation.  The delivery date is calculated from the day after the acceptation of the quotation and/or the reception of the original and correct documents.

Word2Word does not assume liability for delays in delivery beyond its control (illness, accident, temporary disability or force majeure). However, these must be communicated to the client in as soon as is reasonably possible. 

Services

All services are carried out by a qualified professional native in the target language.

  • Translations: the service includes the translation, revision and delivery of the document by email.
  • Proofreading: the service includes a revision of spelling, grammar and formatting errors and delivery of the document by email.
  • Copy editing: the service includes an in-depth revision of style, tone and use of language to ensure a polished text. Includes interventions to adapt the text to the rhetoric of an original English-language text.

The service includes the translation and /or editing of the document text. The typesetting, design and layout of the final document is not the responsibility of the translator, although whenever possible we will undertake to submit a translation with a format as close to the original text as possible. 

Guarantee

The service includes a guarantee period of 14 calendar days, starting from the date of project delivery. After this period, the translation shall be deemed correctly realised and no claim will be accepted. In the event of any complaints or objections regarding the final translation, these must always be made in writing and based on opinions and judgement that are demonstrable. 

Project procedure

The client is responsible for submitting documents that are clear, linguistically acceptable and easily legible in terms of both content and format.

The translator undertakes to carry out all the services offered with the utmost conscientiousness and commitment, therefore ensuring maximum quality. When confirming an order with Word2Word, the client must provide all the necessary information for the correct undertaking of such. This information includes contextualising details of the text (its purpose, mode of publication, intended audience, screenshots of websites, images of objects described etc.) to ensure an optimal translation. In the event that this information is not facilitated while the translation is underway, the translation shall be rendered at face value and the translator shall not be held liable for objections to translations undertaken in the absence of guiding context. If it is not possible to provide this information while the translation is underway, a prepress revision service is offered at an additional cost.

 

  1. Responsibilities and liability

Content and intellectual property rights

Word2Word is not responsible for correcting errors and/or omissions in the original document, although these will be communicated to the client.

Word2Word is not responsible for the content of documents worked with, and the client is fully responsible for the points of view and opinions expressed. Likewise, Word2Word reserves the right of admission regarding the translation/revision of documents of content that it considers inappropriate, morally incorrect, that challenges public order or that may be considered illicit.

When confirming an order, the client warrants that they hold the intellectual property rights and any other rights necessary to carry out the project. In the same instance, all the rights needed to carry out the translation are transferred to Word2Word. If the rights of third parties are infringed upon with the translation, the client releases Word2Word from any liability arising from complaints made by third parties, including any legal costs that may occur.

Confidentiality

All information and documentation provided by the client is subject to the greatest professional secrecy, both while the service is underway as well as afterwards. Under no circumstances shall Word2Word divulge information on documents or client relations with third parties, unless in the event of having to comply with legal obligations.

  1. Rates; terms and conditions of payment

Rates

The current rates are those stipulated in the quotation. Rates do not include VAT (where applicable).

Rates are revised periodically.

Terms and conditions of payment

Payment is to be made in Euros by means of a bank transfer. Banks charges are to be met by the client.

The terms of payment are stipulated in the quotation, and will be as follows, depending on the case:

– An upfront payment of the total value of the quotation (including VAT) is required for official translations and for the first project/client transaction.

 For subsequent orders:

 – An advance payment of 50% of the total value of the order (including VAT) is required upon accepting the quotation, with the remaining 50% payable within 7 calendar days of project delivery.

 Delivery expenses of documents incurred through the use of means other than email will be met by the client.

 Procedures for late and/or non-payment

Any delay in payment or failure to pay will provoke an immediate demand for the full payment by the client of the outstanding amount, without need for prior warning or any other formality. Word2Word reserves the right to seek interest calculated in relation to the official interest rate of the Bank of Spain in force on the date on which the payment should have been made. In any case, the client must reimburse expenses incurred by Word2Word in the resolution of the matter.

 Cancellation of the order

In the event of an order being cancelled, Word2Word shall invoice the client for all the partially translated documents or files in accordance with the rate stipulated in the quotation.

 

  1. Jurisdiction

The contractual relation between Word2Word and the client will be exclusively governed by Spanish law. All litigation with respect to the interpretation or execution of these terms and conditions shall be subject to the exclusive jurisdiction of the courts and tribunals Figueres (Girona) with express waiver by both parties of any other jurisdiction to which they could be entitled.
